AMENDED LABOUR BILLS & CONSULTATION SESSIONS
Following the Gazetting of four labour related bills in
December 2010, FSA circulated to members its comments thereon which were
subsequently forwarded to the Department of Labour for consideration -
one of 329 received. Our submission was apparently similar to others made by
organised industry/ business structures in that we felt that the Bills, if
passed in the original form, would have a huge negative impact on employment in the country. The Bills in question were the following:
- Labour Relations Amendment Bill
- Basic Conditions of Employment Amendment Bill
- Employment Equity Amendment Bill
- Employment Services Bill.
After receipt of public submissions, the Bills were tabled
for discussion at Nedlac. After one year of debate, although certain
amendments have been made through negotiation, no overall consensus thereon was
reached by the three parties involved (particularly regarding the issue of
labour broking). Despite this lack of agreement, the Government has
nevertheless decided to table two of the Bills, namely, the Labour Relations
Amendment Bill and the BCE Amendment Bill before Parliament.
I have, for your perusal and information attached six files,
namely a summary of decisions taken, a summary of changes to each Bill and the
actual amended Bills as well as FSA's original submission.
As is indicated in the summary document, a series of public
information sessions will be held during April. Please note that these
are purely information sessions and participants will thus not be able to give
input into proceedings other than participating in a question and answer
session. Although the benefit of attending these sessions is therefore in
question, those wanting to attend should note the following dates and venues
(meetings in all cases are scheduled to take place between 10h00 and 13h00):

If deemed necessary, FSA will make an additional submission
on these amended Amendment Bills. Should you wish to supply FSA with any
comments that you would like included in our submission, please send them
through to me as soon as convenient.
